The state of Colorado now prohibits employers from demanding, confiscating, retaining or otherwise requiring employees, job applicants and other individuals performing or seeking to perform work (including seasonal employees or migrant workers) to surrender their government-issued identification cards.
Under the new law, which was enacted in June 2026, Colorado employers must also provide written notice in English and, if known, in the individual’s primary language, and obtain their acknowledgement that it was received.
The law includes a narrow exception for I-9 verification purposes and situations where retention is required by a state or federal law or judicial warrant.
