On Friday, November 2, 2012, the US Citizenship and Immigration Services (USCIS) published an updated version of its I-140 Immigrant Petition for Alien Worker form. This latest version of the I-140 is dated October 1, 2012, and is set to remain in effect until January 31, 2013.
The I-140 is used, usually by an employer, to petition for a foreign worker to obtain an immigrant visa based on employment or prospective employment in the US.
USCIS has stated that it will continue to accept editions of the I-140 dated January 6, 2010, or later until December 30, 2012. Thereafter, only the October 1, 2012, version will be accepted.
The new form is essentially a reformatting of the prior form adapted with Adobe fillable fields. There is also a slight change in the wording of the declaration signed by those preparing the forms. The declaration now includes a phrase confirming that the information on the petition is true to the best knowledge of the preparer.
