The U.S. Chamber of Commerce filed a lawsuit in the U.S. District Court for the District of Columbia on Oct. 20 seeking to stop the Trump Administration’s $100,000 H-1B Visa fee.

The Chamber is requesting an injunction to block the fee and to vacate any actions the Department of Homeland Security has taken to put it into effect.

Litigation was anticipated when the fee was announced. The lawsuit is the second filed against the fee, joining a previous filing by a group of California businesses, unions, industry groups and individuals.

The Chamber’s lawsuit argues that the fee is “plainly unlawful” and that it violates federal immigration law and the Administrative Procedure Act.

If allowed to stand, the fee would apply to certain H-1B petitions filed on or after Sept. 21, 2025.

Employers who rely on H-1B visa holders to fill key positions should monitor these lawsuits closely.
